6. Community Code of Conduct

Kalpatharu communities are intended to provide a respectful, supportive, constructive and safe environment for learning and personal growth.

Members are encouraged to ask questions, disagree respectfully and provide genuine feedback.

6.1 Respectful Disagreement and Feedback

A member will not be suspended or removed merely for expressing a respectful disagreement, genuine concern or constructive criticism.

This includes:

  • Disagreeing with Kalpatharu or its trainers;
  • Questioning a teaching or methodology;
  • Expressing dissatisfaction;
  • Questioning or criticising programme pricing;
  • Making a genuine complaint;
  • Requesting a refund;
  • Providing constructive feedback.

However, members are expected to communicate responsibly and respectfully.

6.2 Harassment and Abusive Conduct

You must not:

  • Threaten, bully or harass another member, facilitator, employee or coach;
  • Engage in repeated personal attacks;
  • Use abusive, obscene, intimidating or hateful language;
  • Target another person repeatedly after being requested to stop.

6.3 False or Misleading Statements

Members must not knowingly or recklessly circulate materially false or misleading information as fact about:

  • Kalpatharu;
  • Wellness Eutopia;
  • Its coaches or trainers;
  • Employees or facilitators;
  • Other members;
  • Programme pricing;
  • Services, policies or programme benefits.

Nothing in this clause prevents a person from expressing an honestly held opinion, communicating truthful information, providing genuine feedback or making a legitimate complaint.

6.4 Disruption of Community Activities

Members must not intentionally or repeatedly interfere with or disrupt:

  • Classes;
  • Community discussions;
  • WhatsApp groups;
  • Live calls;
  • Challenges;
  • Sadhana activities;
  • Events;
  • Retreats;
  • Other member activities.

6.5 Commercial Solicitation

Unless authorised by Kalpatharu, members must not use Kalpatharu communities primarily to:

  • Sell their own products or services;
  • Recruit customers or clients;
  • Promote competing programmes;
  • Collect member contact information for commercial purposes;
  • Mass-message members;
  • Recruit members into external commercial communities.

Normal personal networking and genuine friendships are not prohibited.

6.6 Privacy of Community Members

Members must respect the privacy of others.

Without appropriate permission, you must not publicly share:

  • Screenshots of private conversations;
  • Personal stories shared confidentially;
  • Phone numbers;
  • Email addresses or other contact information;
  • Health information;
  • Financial information;
  • Recordings of community calls;
  • Other private or personal information of members.

6.7 Illegal or Unsafe Activity

Members must not use Kalpatharu platforms for fraud, impersonation, unlawful activity, threats, illegal financial schemes or any activity that may endanger another person.

7. Warnings, Restrictions and Suspension

We intend to deal with membership concerns fairly, reasonably and proportionately.

Where reasonably appropriate, we may first:

  1. Contact the member privately;
  2. Explain the concern;
  3. Request that the conduct stop;
  4. Issue a written or verbal warning;
  5. Restrict access to a particular group or activity; or
  6. Temporarily suspend participation while the matter is reviewed.

A warning may not be required where the conduct is sufficiently serious or immediate action is reasonably necessary to protect members, staff, intellectual property, safety or the integrity of the community.

Immediate suspension may occur where we reasonably believe there is:

  • Serious harassment or threatening behaviour;
  • Fraud or impersonation;
  • Significant misuse of member information;
  • Unauthorised distribution of paid intellectual property;
  • Serious disruption of an event or community;
  • Illegal activity;
  • A genuine safety concern;
  • A serious or repeated breach after a previous warning.

8. Termination of Membership

Kalpatharu may terminate a member’s access where there is a reasonable and documented basis for doing so, including a serious or repeated violation of these Terms.

Where reasonably practical, the member will be informed of the reason for termination.

Termination decisions may take into consideration:

  • The seriousness of the conduct;
  • Whether the conduct was repeated;
  • Previous warnings, if any;
  • The impact on other members;
  • The impact on trainers, employees or facilitators;
  • The safety and integrity of the community;
  • The services already supplied;
  • The services remaining to be supplied.

8.1 Termination by Kalpatharu for Business or Relationship Reasons

If Kalpatharu decides to discontinue an individual membership for reasons unrelated to a material breach by the member, Kalpatharu will provide an appropriate refund for material paid services that will no longer be provided.

Kalpatharu may, where appropriate, issue a full refund of the amount paid and discontinue the membership if we reasonably determine that continuing the relationship is not appropriate or is not in the best interests of either party or the community.

Once a full refund for the applicable membership or programme has been made, access associated with that refunded purchase may be discontinued.

8.2 Termination Following Misconduct

Where termination results from a serious or repeated breach of these Terms, amounts attributable to services, events, digital products or benefits already delivered or substantially accessed will ordinarily not be refundable merely because the membership has been terminated.

Any amount relating to material prepaid future services that will no longer be provided will be considered reasonably in accordance with our Refund and Cancellation Policy and applicable law.

Nothing in these Terms permits the imposition of a penalty that is unreasonable or disproportionate to the circumstances.

8.3 Internal Review

A member whose membership has been terminated may request an internal review of the decision by contacting us within 7 days of receiving the termination notice.

Kalpatharu may review the available information and communicate its decision within a reasonable period.

This internal review process does not restrict any statutory right or remedy available to the member under applicable law.

9. Refunds and Cancellations

Refunds and cancellations are governed by our Refund and Cancellation Policy.

Nothing in these Terms limits any refund, remedy or consumer right that cannot lawfully be excluded or restricted.

10. Programme Changes

Occasionally it may be necessary to:

  • Change a trainer or facilitator;
  • Modify a session time;
  • Reschedule a class;
  • Change a venue;
  • Update curriculum;
  • Replace a bonus;
  • Change a technology platform.

Minor changes that do not materially reduce the overall programme value do not automatically create an entitlement to a refund.

Where Kalpatharu makes a material change that substantially affects a paid service, we will make reasonable efforts to provide an alternative, credit, rescheduling option or appropriate refund.

11. Intellectual Property

Unless otherwise stated, all intellectual property associated with Kalpatharu programmes belongs to Wellness Eutopia or its respective licensors.

This includes, without limitation:

  • Course videos;
  • Audio recordings;
  • Meditation recordings;
  • Workbooks;
  • Manuals;
  • Presentation slides;
  • Frameworks and teaching methods;
  • Graphics;
  • Logos;
  • Templates;
  • Training material;
  • Written content;
  • App content;
  • Event material.

Purchase of a programme does not transfer ownership of intellectual property. You receive only the personal-use licence specifically associated with your purchase.

12. Member Content

Where you voluntarily post comments, questions, testimonials or other content in Kalpatharu community areas, you remain responsible for what you post.

You grant Kalpatharu the permissions reasonably necessary to host, display, store and technically process such content for the operation of the programme or community.

Kalpatharu will not use a private personal story, photograph, video or testimonial in public advertising merely because it was posted in a private community. Separate consent will be obtained where required.

13. Session Recordings

Certain online sessions, meetings or events may be recorded.

Where a session involving participants is being recorded, reasonable notice will be provided where required.

Recordings may be used for programme delivery, member access, training, quality improvement, internal records or other purposes disclosed to participants.

Use of identifiable participant recordings for public advertising or testimonials will be subject to applicable consent requirements.

14. Health and Wellness Disclaimer

Kalpatharu programmes may discuss subjects such as Reiki, meditation, energy practices, spirituality, lifestyle, emotional wellbeing, manifestation and complementary or drugless wellness approaches.

Kalpatharu does not guarantee any particular income, revenue, profit, sales, business or financial result.

16. Personal Results and Testimonials

Personal-development and wellness programmes may produce different experiences and outcomes for different people.

Testimonials describe individual experiences and do not guarantee that another participant will achieve identical or similar results.

Your results depend upon numerous factors including your participation, circumstances, decisions, consistency and implementation.

17. Third-Party Services

Kalpatharu may use third-party providers for:

  • Payment processing;
  • Video conferencing;
  • WhatsApp communication;
  • Learning management platforms;
  • Email and SMS;
  • Hosting;
  • Analytics;
  • Community management;
  • Other technology services.

Availability of a third-party platform may occasionally be outside our control.

Your use of third-party services may also be subject to the provider’s own terms and privacy policies.

18. Privacy and Personal Data

Personal information will be collected, used, stored and handled in accordance with our Privacy Policy and applicable data-protection law.

You are responsible for protecting your account credentials.

Please notify us promptly if you believe that your account has been accessed without authorisation.

19. Disclaimer and Limitation of Liability

Kalpatharu will use reasonable care in providing its services.

To the maximum extent permitted by applicable law, Kalpatharu will not be responsible for indirect or consequential losses arising solely from a participant’s personal decisions based on educational or personal-development material.

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by applicable law.

In particular, nothing in these Terms limits statutory consumer rights or any liability or remedy that cannot legally be excluded.

20. Responsibility for Misuse

You may be responsible for loss or damage reasonably caused by your:

  • Unlawful conduct;
  • Fraud;
  • Deliberate misuse of Kalpatharu platforms;
  • Infringement of another person’s rights;
  • Unauthorised distribution of Kalpatharu intellectual property;
  • Intentional misuse of another member’s personal information.

Nothing in this section imposes liability beyond what is reasonable and permitted by applicable law.

21. Force Majeure

Kalpatharu will not be considered in breach where performance is prevented or materially delayed by circumstances reasonably outside its control, including:

  • Natural disasters;
  • Severe weather;
  • Epidemic or pandemic restrictions;
  • Government action;
  • Civil disturbance;
  • Major technology or internet outages;
  • Venue closures;
  • Other comparable circumstances beyond reasonable control.

Where such an event materially affects a paid programme, we will make reasonable efforts to reschedule, provide an alternative format, extend access, offer credit or provide another appropriate remedy.

23. Governing Law and Jurisdiction

These Terms are governed by the laws of India.

Subject to any statutory right of a consumer to approach a Consumer Commission or another competent forum in a jurisdiction available to that consumer under applicable law, courts having jurisdiction in Bengaluru, Karnataka will have jurisdiction over disputes arising from these Terms.

The parties are encouraged to first attempt a good-faith resolution of disputes before commencing litigation where reasonably practicable.

24. Changes to These Terms

We may update these Terms where reasonably necessary because of changes to:

  • Law or regulation;
  • Technology;
  • Services;
  • Business operations;
  • Consumer-protection requirements;
  • Community or safety requirements.

Material changes affecting an existing paid programme will not ordinarily be applied retrospectively in a way that materially reduces benefits already purchased unless required by law or expressly agreed with the participant.

The version applicable to a purchase will generally be the version in force when the purchase was made, together with any subsequently accepted programme-specific terms.

25. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the maximum extent permitted by law.

26. No Waiver

Failure by Kalpatharu to enforce a provision on one occasion does not mean that Kalpatharu permanently waives that provision or its right to enforce it later.

27. Entire Agreement

These Terms, together with:

  • The applicable sales or checkout page;
  • The Refund and Cancellation Policy;
  • The Privacy Policy;
  • Programme-specific terms expressly disclosed before purchase;
